Public Works Department Program Policies

I. Purpose

This Policy will be used as a guideline to assure Leech Lake Band Members residing within the reservation service area have opportunity for services described in these guidelines that provide for consistent, equitable and uniform treatment of Leech Lake Band of Ojibwe.

Destribution of funds allowed by the Leech Lake BAnd of Ojibwe to applicants pertaining to this policy, shall be in compliance with the Indiam Gaming Regulatory Act, Section 105 and 106 of the Gaming Revenue Allocation Ordinance, and Leech Lake Tribal Council's Rules of Operations and Procedures.

II. Definitions

Leech Lake Department of Public Works, for the purpose of determining eligibility, shall utilize the following definitions:
1.Family - Two or more persons living together as a family.
2.Elder - A person who is 62 years of age or older and is head of household.
3.Handicapped Person - Any Band Member that submits a Doctor's statement of said disability and/or proof of Social Security Disability.
4.Single Person (non-elder) - A single person who lives alone and does not qualify as an elder.
5.Reservation Service Area - A 20 mile radius outside the exterior boundaries of teh Leech Lake Reservation.
6.Proof of Ownership - Documents; such as deeds, purchase agreements, land leases, certificates of title, bills of sale, etc., that support the owenership of applicant.
7.Dependants - Dependant children under the age of 18 or dependant elder/handicapped person.
8.Income - Income includes earned and unearned income from all sources. (Does not include stipends, mileage or other reimbursements).

All income must be verified.

If you are claiming 0 income on your application, you are required to show a letter of denial of assistance from the county of you residence.

III. Eligibility

Leech Lake Band Members Requesting assistance, must meet the following requirements;
•Any Leech Lake Band Member, over the age of 18, residing within the service area.
•Completed application, with supporting documentation.
•A Band Member who provides false information is subject to all criminal and civil sanctions to the Band, under applicable law.

IV. Application Package

All persons seeking assistance shall first complete an application.

The assistance application shall consist of the following:
•Screening process cover letter
•Verification of income form
•Release of information form
•Application for assistance form

The Program shall require All Applicants to provide documentation and information necessary to determine eligibility and establishing priorities. To include, but not limited to: Family composition, Enrollment status, Income Verification, Property Ownership (titles, leases, purchase agreements, deeds, etc.).

The responsibility of providing documents shall be on the applicant.

V. Selection Process

The Program, in realizing that funds allocated are limited, shall give perference to the Band Member's application in the following order:

Assignment to a Waiting List.
1.Family Compostion Status
2.Date of application
3.Level of need - Emergency/Non-emergency

As applicants are served, their names will be removed from the list.

VI. Allowable Services
1.Replacement of existing water supply and/or waste disposal systems.
2.Repairs and renovation fo existing driveways.
3.Clearing and construction of new lots and driveways. ◦Restricted to: one (1) new lot every five (5) years.

4.Demolition and removal of burned units.
◦Home or Mobile home
5.Mobile Home Relocation
Requirements for Mobile Home relocation: ◦Mobile home evaluation form
◦Proof of ownership
◦Land lease/agreement
◦Tax release fro mcounty (If not on Indian Land)
◦When a Mobile home is pruchased from a dealership, it is the responsibility of said dealer to relocate that home.

6.We are NOT equipped to move buildings.
7.We do NOT provide vouchers to vendors for any servcie provided to clients.
8.Reimbusements to applicants for payments made to vendors for services or material shall not be paid.
9.Reimbursements to applicants for payments made to vendors for services or materials shall NOT be paid.

VII. Repayment Agreement

The following chart shall be utilized to determine the level of repayment, if applicable.

1.Gross Income - Income should be calculated according to pay schedule ◦Salaried - take annual salary and divide by 12 months
◦Paid Weekly - take weekly gross check x 52 weeks divided by 12
◦Paid every other week - take weekly gross x 26 weeks divided by 12
◦Paid on the 15th/30th - take gross check x2

2.Additional Income - Any other sources of income that is received on a regular basis (e.g. SSI, Child Support, retirement, disability)
Additional income is not taxed so to get a "gorss income" figure - multiply the amount by 1.22 (i.e. 400 in ssi - 400 x 1.22= 488)
3.A Band Member who has elder status will not be required to sign a repayment agreement for a one (1) time expenditure within a five (5) year period. If the Band Member with elder status receives additional services, a repayment agreement will need to be signed.

Incremental scale for repayment is set at 25% intervals up to 100%. If a Band Member's income source falls within the 25% range, then the Band Member shall be responsible for repayment of 25% of the benefit.

Dependants to be considered in determining level of assistance:

In the case of a Band Member caring for foster children - a referral shall be provided to the Social Service agency providing foster care licensing for the foster children. Foster chilren shall not be considered in determining family size.

In the case of a Band Member caring for other children -written verification for custody must be provided in order to include them in the level of asissistance available above.
